Assumption of Risk and Covenant

As consideration for your use of Ski Bromley, LLC’s premises and facilities at Bromley Mountain Ski Resort (“Resort”)By purchasing a lift ticket at Bromley Ski Resort, you agree to the following when you purchase a Resort lift or activities ticket:
I You accept and understand, willingly accept and expressly assume the risks and hazards, inherent or otherwise, of that skiing, snowboarding, using lifts, and other forms of winter and summer mountain sports and activities (“Activities")are hazardous with many inherent risks and which may resulting in injury, severe illness, permanent disability, death, or property damage injuries or death. By my purpose and use of this ticket, I freely and willingly accept and voluntarily assume all risk of property damage, personal injury or death which occurs at the Bromley Ski Resort which results from my participation in winter sports activities and the inherent risks of such activities as they are defined herein, and .damage to your equipment or apparel associated with exposure to grease, mud, water, ice, and other natural elements prevalent in a mountain resort recreational environment.

You agree that the phrase, "risks and hazards, inherent or otherwise,inherent risk" means those risks and hazards which are listed in this agreement here and those that can reasonably be inferred therefrom and includes changing weather conditions; surface and/or subsurface snow conditions as they may exist or be affected by weather, skier, or other participant usage, and which may consist of ice, hardpack, powder wind pack, corn, crust, slush, cut up snow, machine made or groomed snow; bare spots, forest growth and debris, stumps and trees, streambeds and other natural objects, and/or collisions with such objects; collisions with lift towers, signs, posts, fences, pipes, with other people, skiers or snowboarders; other manmade structures and/or their components such as hydrants used for snowmaking, or for other necessary purpose, collisions with well marked/well-marked or plainly visible snowmobiles, snow grooming, and/or other area Resort snow vehicles or equipment, variations in steepness of terrain modifications or changes, equipment failure; equipment malfunction; falling, slipping, jolting, jarring or shaking; uneven and/or slippery ground or track conditions, high elevation; encounters with plants, insects or animals; breaks, sprains, strains, bruises and other contusions; my health condition, physical exertion, dehydration, fatigue, anxieties and fears associated with heights, dizziness; illness, including exposure to and infection with viruses or bacteria.

You agree not to bring a claim against Ski Bromley, LLC, its landlord, officers, managers, agents, employees, and representatives, and their successors in interest for any and all liability, claims, demands, actions, or causes of action arising from your participation in the Activities, participation in the Activities, your use of the Resort’s equipment, your presence on the Resort, damage to your equipment or apparel from exposure noted above, or related to any other activity at the Resort; including any injury, loss, or damage that you may now have suffered, or of which you are not aware or that is not mentioned in this covenant. This covenant also applies to any injury, loss, or damage resulting from anything that has happened at any time through the date of the ticket. 
You agree that any dispute arising out of this agreement contract and/or from your any use by me of any of the Resort premises or facilities at the Bromley Mountain Ski Resort shall be litigated exclusively in the Superior Court of Bennington County, Vermont, or the U.S. District court for the District of Vermont, as applicable, and those courts have personal jurisdiction.

You also agree to abide by the terms of any posted rules of conduct for the Activities and the Resort as contained on seasonal trail maps or brochures.
12 V.S.A. § 1037-1038) govern your use of the Resort.
